Since 2011, the most successful way to challenge consultation decisions has been on Equality grounds.

This is because too few people understand what the Public Sector Equality Duty requires and how to apply it to engagement, consultation and associated decision making.
This Applying Equality Duty to Consultation and Engagement course addresses these issues by taking participants through the statutory duties and common law requirements that have evolved since 2011. Using a mix of instruction, exercises and case law examples, the course guides those fulfilling the duties in how to undertake equality analysis and produce equality impact assessments (EqIA) for different scenarios. The course also demonstrates when due regard must be applied and how decision makers should apply it.
